OVERVIEW
This website, untappedpotentialtcg.co.za, is operated by Untapped Potential TCG (Pty) Ltd. When we say "we," "us," or "our," we mean Untapped Potential TCG (Pty) Ltd. By using our website or buying from us, you agree to follow these Terms of Service ("Terms"), along with any other policies or notices linked on our site.
These Terms apply to everyone who visits our site, including browsers, customers, and vendors. Please read them carefully. If you do not agree, you may not use our website or services.
Any new features or tools added to our store will also follow these Terms. We may update or change these Terms at any time by posting changes here. If you continue using our site after updates, you accept the new Terms.
Our online store is hosted on Vercel Inc., with order and account data stored by Supabase Inc. Together these providers supply the infrastructure that lets us sell our trading card game products and services to you.
Nothing in these Terms takes away or limits any right you have under South African law, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"). Where any clause here conflicts with those rights, your statutory rights apply.

Our Privacy Notice explains how we handle payment information and personal information, and our PAIA Manual sets out the records we hold. We do not currently subscribe to an industry code of conduct or an alternative dispute resolution code — see Section 22 for how disputes are handled.
Keeping a record of your order. We email you an order confirmation when you place an order, and if you have an account your full order history stays available under Account → Orders. You can save or print either at any time. Please keep your order confirmation as your record of the transaction.
SECTION 2 – ONLINE STORE TERMS
Online accounts and orders are intended for people aged 18 or older, or for a parent or guardian ordering on a child's behalf. Minors are welcome to use the site and to take part in our in-store events under the supervision and with the consent of a parent, guardian or other competent person.
You may not use our products for anything illegal, and you may not violate intellectual property rights (e.g. Pokémon, Magic: The Gathering).
SECTION 3 – GENERAL CONDITIONS
- We may refuse service to anyone, on reasonable grounds and consistently with the CPA.
- You may not copy, sell, or exploit any part of our services or content without our written permission.
- Headings in these Terms are for convenience only.
SECTION 4 – ACCURACY OF INFORMATION
We take care to keep product information accurate, and we describe card names, sets, finishes and conditions in good faith. Occasionally details may be outdated, incomplete or incorrect. If a listing was wrong in a way that matters to your purchase, tell us and we will put it right under Section 20 or our Refund & Returns Policy.
SECTION 5 – CHANGES TO SERVICES AND PRICES
- Prices may change at any time, but never after you have placed and paid for an order.
- We may modify or discontinue services at any time.
SECTION 6 – PRODUCTS AND SERVICES
- Some items are limited in quantity and may only be available online.
- Returns and exchanges are governed by our Refund & Returns Policy and by Sections 20 and 21 below.
- Images are representative, but product colours may vary by screen.
- We may limit sales quantities or restrict sales for high-demand products.
Card condition. Singles are sold in a stated condition (for example Near Mint, Lightly Played, Moderately Played). Where we have expressly described a card as being in a specific condition and you have agreed to buy it in that condition, that condition is what you are buying and it is not a defect. This does not affect your rights if a card arrives in a materially worse condition than described, or is damaged in transit.
SECTION 7 – BILLING AND ACCOUNT INFORMATION
- We may refuse or cancel any order, especially limited or high-demand items. If we cancel a paid order, we refund it in full.
- You must provide accurate and current details (billing, shipping, and contact information).
- If the details you give us are incorrect and that causes a delay or a failed delivery, we will help you sort it out, but we cannot be responsible for the delay itself.
Payment Methods: We accept card and instant EFT payments processed through Stitch, manual EFT, and payment in store for collection orders.
Payment Confirmation:
- Card and instant EFT (Stitch): An order is considered paid once payment is successfully authorized/confirmed through Stitch and reflected as paid/processing in our store system. If a payment fails, is reversed, or is flagged by the payment provider, the order may be cancelled and stock may not be reserved.
- Manual EFT: Orders paid via EFT may only be processed once cleared funds reflect and/or proof of payment has been verified (where applicable). Stock for EFT orders may not be held indefinitely and may be released if payment is not received within a reasonable time. We will tell you before releasing stock.
Fraud Prevention / Verification: We may request additional verification for certain orders (including high-value orders) to prevent fraud and protect customers. If verification is not provided, we may cancel and refund the order in full.
SECTION 8 – OPTIONAL TOOLS
We may provide access to third-party courier or integration tools. We choose our providers with care, but we do not control their systems and cannot be responsible for how they operate.
SECTION 9 – THIRD-PARTY LINKS
Links on our site may lead to third-party websites. We are not responsible for their content, accuracy, or policies.
SECTION 10 – USER COMMENTS AND FEEDBACK
- If you send us feedback, ideas, or submissions, we may use them without obligation to you.
- You are responsible for ensuring your submissions are accurate and lawful.
SECTION 11 – PERSONAL INFORMATION
Your personal information is handled under our Privacy Notice, issued in terms of POPIA. Requests for access to records follow our PAIA Manual.
SECTION 12 – ERRORS AND OMISSIONS
We may correct errors or update information (including pricing and availability) at any time without prior notice. Where an obvious pricing or listing error affects an order you have already placed, we will contact you before cancelling, and any payment you have made will be refunded in full.
SECTION 13 – PROHIBITED USES
You may not use our site for unlawful purposes, to violate intellectual property, to harass others, or to disrupt site security.
SECTION 14 – WARRANTIES AND LIMITATION OF LIABILITY
- We do not guarantee that the website will be uninterrupted or error-free.
- Goods we sell carry the implied warranty of quality set out in sections 55 and 56 of the CPA. We do not sell goods "as is" or "voetstoots", except where we have expressly described an item as being in a particular condition and you have expressly agreed to accept it in that condition (see Section 6).
- Subject to the paragraph below, we are not liable for indirect or consequential loss.
- Nothing in this Section limits our liability where the law does not allow it to be limited, and nothing in it waives, deprives you of, or limits any right you have under the CPA — including your rights under sections 55 and 56.
SECTION 15 – INDEMNIFICATION
You agree to indemnify Untapped Potential TCG (Pty) Ltd against claims or costs resulting from your breach of these Terms, to the extent permitted by law.
SECTION 16 – SEVERABILITY
If any part of these Terms is found invalid or unenforceable, the remaining provisions remain in force.
SECTION 17 – TERMINATION
- You may terminate these Terms by ceasing to use our services.
- We may suspend or terminate your access if you breach these Terms.
SECTION 18 – ENTIRE AGREEMENT
These Terms, together with our policies, form the complete agreement between you and us.
SECTION 19 – GOVERNING LAW
These Terms are governed by South African law, and the courts of South Africa have jurisdiction.
SECTION 20 – SHIPPING AND DELIVERY
- We deliver within South Africa via PostNet (branch-to-branch and door-to-door where available) and PUDO (locker and pickup point), and you can collect free of charge from our store. Available options are shown at checkout.
- Shipping costs and estimated delivery times are shown at checkout before you confirm your order. Delivery times are estimates and not guaranteed.
- Your parcel stays at our risk until you accept delivery of it. If your order is lost, stolen or damaged in transit, contact us — we will trace it, and if it cannot be recovered we will replace it or refund you. You do not have to claim from the courier yourself, and you do not lose your rights against us because the courier was at fault.
- Please give us accurate delivery details (address, branch or locker, and contact number). If a delivery fails because the details were wrong, we will help you re-route or resend it, and any additional courier charge for the second attempt may be for your account.
- Where you have chosen a collection method (PostNet branch or PUDO locker), please collect within the courier's allowed window. If a parcel goes uncollected and comes back to us, we will contact you to arrange redelivery or a refund. We will not dispose of your parcel or keep your money without contacting you first. If we have to redeliver, the additional courier cost may be for your account.

SECTION 21 – YOUR RIGHT TO CANCEL AN ONLINE ORDER (ECTA SECTION 44)
Because you are buying online, section 44 of ECTA gives you a cooling-off right in addition to everything else in this document:
- You may cancel your order for any reason, or no reason at all, within 7 days after you receive the goods, without penalty.
- We refund the full purchase price, including the original delivery fee, within 30 days of cancellation.
- The only cost you carry is the direct cost of sending the goods back to us.
- Goods must come back to us unused and in the condition you received them.
This right does not apply to sealed product you have opened, because trading card product cannot be resold once opened (ECTA section 42(2)(f)). It also does not apply to purchases made in store, where the law gives no cooling-off right — though we will still help where we reasonably can.
If you bought as a result of one of our marketing emails or messages, section 16 of the CPA gives you a separate right to cancel within 5 business days.
SECTION 22 – RETURNS, DEFECTS AND REFUNDS
You have three separate routes, and you may use whichever applies:
- Cooling-off (7 days, online orders): as set out in Section 21 — no reason needed.
- Wrong or damaged on arrival: tell us within 7 days of delivery and we will replace the item or refund you, including delivery costs both ways. Photos help us resolve it faster and sort out the courier claim on our side, but they are not a condition of your refund.
- Faulty or not as described (6 months, CPA section 56): for six months after delivery you may return goods that are unsafe, defective or not as described, and choose a repair, a replacement or a refund. Returns of defective goods are at our risk and expense — we cover the cost of getting them back to us.
Refund method: refunds go back to the original payment method — card and instant EFT payments via Stitch to the same card or account (your bank's processing time then applies), and manual EFT payments by EFT to the payer's account, where we may verify the account holder's details to prevent fraud.
For singles, we verify that a returned card is the card that was sent and matches the condition it was sold in. Full detail, including pre-orders, is in our Refund & Returns Policy.
SECTION 23 – COMPLAINTS AND DISPUTES
If something has gone wrong, please contact us first — most things are quickest to fix directly. Email untappedpotentialtcg@gmail.com with your order number and we will acknowledge within 2 business days and aim to resolve within 15 business days.
If we cannot resolve it between us, you may refer the matter to:
- The National Consumer Commission — thencc.org.za, 012 428 7000, complaints@thencc.org.za
- A consumer court in your province, or a court of competent jurisdiction.
